Photographer Gets The Money Photo Of Halle Berry's Baby, Then Gets Sued By Halle Berry
 

Halle Berry is suing the paparazzo who snapped pictures of her four-month-old daughter recently. The photo captions said that mother and daughter were "out and about," but they were actually in Berry's garden. Berry is accusing the photog of trespassing on her property in order to get the shots; in California, that's a criminal offense. Earlier, Berry told the AP: "I have long since come to terms with the fact that choosing a career as an actress has made me a public figure, but my baby has made no such choice, and unless and until she does, I will do everything I can… to keep her out of the public eye."

Doesn't trespassing require him to be in the yard? If he took it outside the yard, I really don't think that qualifies as trespassing. Unless she plans on sealing up the kid in a dungeon, the fact is that she will be in the public eye to some extent. The other alternative would be to:
a) move to NYC where fewer people will care about your existence
b) quit acting AND move to the middle of no where

I think that the photos inside her own garden do count towards trespassing per the stalking laws. There is an expectation of privacy when someone is at their home so this counts too. And the photog knew that which is why he lied and said Halle was "out and about".

She certainly appears to be in a private area. She definitely isn't "out and about" on the street, in a car, or at a restaurant. If the photog was on the neighbor's property, peering with telephoto lens to capture the pic, does that count as trespassing?

Besides, it's not even that good of a money shot. I'm mean, sure, it's the first photo of Halle's baby, however, I'm sure there's a publication out there just waiting to get the rights to the first posed family picture.

I could be wrong but I think the law is if you are inside your home, you are protected from people taking pictures of you — through your bedroom window, for example. But once you step one foot outside (even if you are on your own property and a serious zoom lens is used) you are in the public domain, you become public property and you are legally open to being photographed. So, this one might get thrown out, as I understand it. (Now, all that said, Halle is on my nerves. Woman, you done SHOWED 98% of the world 98% of your body. 'Choice' as an actress. SMH This whole world has seen your butt, your breasts… (except me…I didn't see Swordfish or Monster's Ball because I don't want to see all that pornographic confusion) but all this cat & mouse, hot & cold, pout & cheese, bait & switch at the cameras is on my nerves, Halle. smh

…and the reason I think this is remember how Cher would get so tired of the paparazzi camping outside her door that she put on purple mud masque and rollers to go outside to get her mail? They would sit right outside her home and take her picture, so she would look atrocious so they couldn't get any good shots of her. LOL I can't think of any celeb photos they've snapped on their own property lately, though. I do remember there was that big case when they snapped Jennifer Aniston sunbathing topless by her pool and that was a huge lawsuit…. so I'm not quite sure what the law is anymore.

In France, this would be illegal as the person who took the photograph of Brangelina & kids & memaw in the French property is getting sued as is the person who took the photographs of the boars on their property. They likely chose France to deliver their twins because of the very stringent anti-paparazzi laws put in place post-Princess Di crash. In the US? Don't think so. In the Aniston one, it might be because she was nude and non-consenting.
