In a 5-4 ruling, the U.S. Supreme Court decided that a death penalty sentence for the crime of child rape — when the crime did not result and was not intended to result in a child's death — constitutes cruel and unusual punishment. [Reuters]
The death penalty in general is cruel and unusual. Anyone who commits such a heinous crime shouldn't have the luxury of opting out of living with themselves.
Killing someone isn't the worst thing one can do to them.
This being said, I say take him out of death row, put him in jail cells with the fathers of young girls and let karma work its magic every f-ing day of his miserable life.
Furthermore, it's sickening to me to see all the media hoopla surrounding this decision, not arguing the technicalities but using the most brute language to render the most "hits" and comments…that's annoying.
I actually read the majority decision and it's quite sound. One of the points made is that a child's testimony is often not very credible. Sorry, it's true. Children can be easily manipulated by the adults in their lives. Children will honestly come to believe their lies, even more so than adults. In fact, the case that prompted this decision was such a case. The little girl gave two greatfully differing accounts of what happened.
There is also the difficulty of getting victims to come forward. Most child molestations happen within families or by close friends or associates. This might make it more difficult for a child to come forward if they think that their dad,stepfather,uncle, etc might die for this. Sadly, children are often extremely attached to their abusers and terribly emotionally conflicted.
