From the AP: "A Muslim civil rights group has filed a federal complaint on behalf of a Muslim teenager who alleges she was denied a job at Abercrombie & Fitch because she wears a hijab, or head scarf. The complaint, filed at the Oklahoma City office of the Equal Employment Opportunity Commission, claims that a district manager for the clothing store at Woodland Hills Mall told the girl in late June that the head covering, worn by observant Muslim women, didn't fit the chain's image. 'Employers have a clear legal duty to accommodate the religious practices of their workers,' said Razi Hashmi, executive director of the Council on American-Islamic Relations-Oklahoma, which helped the girl file the complaint. 'To deny someone employment because of apparent religious bias goes against long-standing American traditions of tolerance and inclusion.'"
AF don't play with their image. Some (white) girl almost got fired at my store for having blonde hair and brown extensions in the back. Its not a natural look. Come to think of it, I have not seen her in a while.
Would such a lawsuit hold water against a place like Hooters? Why would a person who wore headscarf want to work in such a place?
good point, Tariq. I'm a Muslim and where I live, 99% of shoppers at AF are middle class (or upper middle class), white, and preppy. not the kind of people i socialize with.
I'm with AF on this one. I know muslims who worked in AF, but they weren't the ones who wore hiajabs. Hijabs aren't part of the AF look.
Why would someone in a head scarf want to work in a place like this? Who knows? Maybe she doesn't find it as morally reprehensible as you do. Maybe its the closest place to her home where she can find a job. Maybe she loves AF jeans and wants the employee discount. Whatever.
The question is whether or not this woman wearing a headscarf at work places some kind of out-of-the-way and undue hardship on AF. It seems to me it doesn't, but who knows? The this-is-so-not-us argument might fly in court. Perhaps it'd work somewhere like Hooters, but I think AF will have a harder case to make.
And I'm glad there are Muslim groups pursuing this type of impact litigation. I think now is definitely the right time for them to be pushing back and making it clear that this type of discrimination is unacceptable.
I didn't say it was morally reprehensible to work at AF. I am saying that if I know that a place has a certain image, then why would I want to work there? This is why I mentioned Hooters.
It is sort of like wanting to work at McDonald's and wanting to wear your own clothes. They dress somewhat racy (at least more racy than the person dresses). Again, I don't know why she would want to work there knowing that she wants to wear a headscarf. It is NOT like being fired because of one's race. AF has a dress code and a head scarf if apparently not part of it. Why should someone MAKE it be a part of their dress code?

AF has a loooong history of racism. An observant hijab wearing muslim wanting to work there strikes me as BULLSHIT. This is a set up pure and simple.

Unlike the Burger King mess, everyone knows that only white people and a handful of East Asians shop at Abercrombie. The type of people who shop there really don't give a s–t about this issue so best get a job at a department store, NY&co., Talbot's, Ann Taylor or something because unless Islam has started smiling on the sorostitute look with a hijab, you can't work there. I'm guessing that the fact that she looks ethnic has far more to do with it than the hijab. She should have looked around and realized that only very clearly super white people work there. I've never even seen a Mediterranean looking person in there and I used to go with my roommate in college.

I'm with AF as well. Why would somebody that has conservative values want to work at a store in which the shorts BARELY cover the butt-cheeks? Heck, even Victoria Secret appears to be more conservative than AF, perhaps she should work there.

Who is talking about racial discrimination? We are talking about RELIGIOUS discrimination from which is covered in the Civil Rights Act. Did you really not know that?

I have a job that requires a working knowledge of workplace discrimination issue, so I realize it isn't common knowledge, but please educate yourself. Google Title Vii of the Civil Rights Act.
